Who Emilio Lozoya is and why his case matters in October 2026

Lozoya coordinated international liaison for Enrique Peña Nieto’s 2012 campaign and then ran Pemex, the largest company of the Mexican State. In 2017, a report revealed that Odebrecht had allegedly paid him more than US$10 million to win a US$115 million refinery tender, according to Expansión Política; he denied it before the then PGR. 2019: the disqualification that came before the arrest

The first final decision against Lozoya did not come from a criminal judge. On 22 May 2019, the Ministry of Public Administration disqualified him for ten years for omitting from several asset declarations a bank account with balances of hundreds of thousands of pesos, according to Expansión Política. It was the first time the ministry had disqualified a former head of Pemex, according to El Financiero. Lozoya challenged it and on 5 February 2020 the Superior Chamber of the Federal Court of Administrative Justice upheld the sanction by majority, according to MVS Noticias. Weeks later he was under arrest in Spain.

2020: Málaga, extradition and release as a witness

Spanish police arrested him in a residential area of Málaga in February 2020. In June he accepted extradition, as the then Attorney General Alejandro Gertz Manero confirmed, according to La Silla Rota, and on 17 July 2020 he arrived in Mexico in FGR custody. According to Expansión Política, he passed through a hospital over alleged health problems and appeared by video link. A control judge bound him over for trial for bribery, transactions with illicit proceeds and criminal association, but granted him conditional release under the cooperation mechanism so he would testify. In that statement he implicated Ricardo Anaya, Jorge Luis Lavalle and his successor at Pemex, Carlos Treviño, according to Infobae and La Silla Rota. What it means: the extradition opened a negotiation, not a trial.

2021: the dinner that sent him back to prison

In November 2021, after images of him dining at a luxury restaurant in Mexico City were circulated, a judge ordered justified pre-trial detention over flight risk, according to La Silla Rota. The conditional release of 2020 ended there. Lozoya remained at the Reclusorio Norte, where the hearings of the following two years would be held.

2023: the deal that never was and the Agronitrogenados suspension

In January 2023 a hearing was held to negotiate a reparation agreement. On 10 March 2023, at the intermediate hearing of the Odebrecht case, the State demanded more than 200 million pesos from Lozoya and his family and, on the criminal track, up to 46 years in prison; the defence offered US$10.7 million for both cases. There was no agreement, according to Infobae, and Lozoya remained subject to ordinary proceedings. The FGR also sought 22 years in prison for his mother, Gilda Margarita Austin, over the handling of the Agronitrogenados money, according to ABC Noticias. On 31 August 2023, a control judge suspended the Agronitrogenados case, accepting that the reparations agreed by Alonso Ancira, of more than US$216 million, also benefited Lozoya, according to La Jornada. The organisation TOJIL, which asked to be recognised as a victim, questioned the legality of applying the cooperation mechanism to a case of this magnitude.

2024: the ankle tag and the first reactivation order

In February 2024, another judge allowed him to follow the Odebrecht case in freedom, under house arrest with an electronic ankle tag, according to Infobae; the FGR called the benefit «illegal» and appealed. In April 2024, the defence obtained an injunction suspending Agronitrogenados, according to Proceso. In November 2024, an appeals court sided with the FGR and ordered that case reactivated. By then, Ancira had stopped paying the remaining US$112.5 million of his reparations, according to Diario.mx.

2025-2026: injunctions, the lost house and the second order

In December 2025, the defence secured a new provisional suspension by injunction in Agronitrogenados, according to Infobae. Meanwhile, the State won through the civil courts: the First Collegiate Civil Court of the First Circuit upheld the asset forfeiture of his residence in Lomas de Bezares, valued at more than 51 million pesos, which passed to the State, according to Infobae. In July 2026, a federal court ordered Agronitrogenados reactivated for the second time, according to El Universal; the FGR had already sought 15 years in prison at the intermediate hearing, but the trial could not begin because of pending appeals, according to Diario.mx. What it means: as of October 2026, the only enforced judicial result against Lozoya is the loss of a house.

What was left out: Grupo Fertinal

In 2015, Lozoya promoted the purchase of Grupo Fertinal for 635 million dollars, with an estimated overprice of 193 million on a bankrupt company, according to Infobae. Pemex filed a complaint with the FGR in March 2019, but Lozoya was never charged: according to Proceso, prosecutors closed that line. It is recorded as background, not as a proven fact.

What Lozoya says and what his accusers say

Lozoya maintains that he acted on instructions from superiors in the Peña Nieto government and offered his testimony in exchange for reduced liability; his defence has used injunctions and appeals to stall Agronitrogenados and has secured that he follows the proceedings from home. The FGR replies that he received US$10.5 million from Odebrecht and commissions from Ancira, that the reparations offered are insufficient and that the house arrest is illegal. TOJIL, as a recognised victim, questions that a case of this size was negotiated under the cooperation mechanism.
